The European Court of Justice has rejected Austria's appeal against the European Commission's 2014 decision to approve the UK's support for the Hinkley Point C nuclear power plant, which is under construction in Somerset, England. The Court of Justice, the supreme court of the European Union in matters of European Union law, agreed with the Commission that the project is in line with EU state aid rules.

Gerard Hogan, advocate general of the European Union Court of Justice said in a non-binding opinion that EU judges should dismiss an appeal by Austria aimed at overturning the approval of UK aid to support construction of the Hinkley Point C nuclear power plant. He added that a lower EU tribunal was “fully entitled” to dismiss the Austrian challenge.

The nonbinding advisory opinion from advocate general Gerland Hogan recommended that the European Court of Justice uphold a lower court decision to dismiss a complaint alleging unfair government funding of Hinkley Point C.
“It is clear that the development of nuclear power is, as reflected in the Euratom Treaty, a clearly defined objective of EU law,” Mr Hogan wrote.
The Court of Justice is not required to follow the advice in advisory opinions, but it does some 80% of the time.
Austria in 2015 challenged the European Commission’s decision to back the UK measures, after a number of agreed changes. Austria lost in 2018 and appealed one last time.

The General Court of the European Union (the EU’s second highest court) on 12 July dismissed a lawsuit against the European Commission's approval of state aid for the planned Hinkley Point C nuclear plant in the UK, which was filed by Austria and supported by Luxembourg. According to the court, the EC "did not err" in accepting the UK's position that construction of the plant is in the UK public interest.

The UK government’s plans to leave the European Union (EU), and consequently the European Atomic Energy Community (Euratom), could threaten plans to build new nuclear reactors and decommissioning activities, as well as jeopardise energy security due to the impact on nuclear fuel supplies, according to a new report by the Institution of Mechanical Engineers (IMech). The intention that the UK should leave Euratom was announced in the recent ‘Brexit Bill’, in part due to Euratom being enforced by the European Court of Justice and managed by EU institutions.
